Section 32 of the Act

Section 32 of the FOI Act provides for refusal of access to certain records whose disclosure is prohibited, or non-disclosure authorised, by other enactments. For the purpose of informing  the Oireachtas Joint Committee's review process, section 32 also provides that each Minister must provide it with a report on the enactments within their area which contain non-disclosure provisions. Each Minister must lay a copy of that report before each House of the Oireachtas and must also provide a copy to the Commissioner who then presents his opinions and conclusions to the Joint Committee.
