30.05.2007 Launch of Information Commissioner's Annual Report 2006

In her Annual Report for 2006, published today, the Information Commissioner, Emily O'Reilly, observes that, 10 years following its enactment, the Freedom of Information (FOI) Act is still being used effectively to achieve openness and accountability in public service despite a decline in overall usage. However, the Commissioner expresses her concern that a number of public sector bodies of considerable significance continue to be excluded from the scope of the Act. Among these bodies are the Vocational Educational Committees, the Central Applications Office, the Adoption Board, the Personal Injuries Assessment Board, the Irish Red Cross, the Office of the Refugee Appeals Tribunal, and the Irish Financial Services Regulatory Authority.

26.02.2007 Information Commissioner's Report on FOI Requests for Records which do not exist or cannot be found

The Information Commissioner, Ms Emily O'Reilly, has today published the report of her investigation into the manner in which public bodies have used the Freedom of Information (FOI) Act to refuse requests that involve searches for records. Section 10(1)(a) of the Act permits a public body to refuse a request for a record where that record does not exist, or where it cannot be found after reasonable searches have been conducted for it.
