The judgement, given by Mr. Justice Quirke on 20th May 2003, up-held the Commissioner's decision in a case which centred on section 10(1)(a) of the FOI Act. The effect of the decision was to affirm the then Commissioner's interpretation of his role in search cases.
An electronic version of the judgement is not yet available from the Courts Service but, in circumstances where the current Commissioner has relied on the judgement in a number of decisions since it issued, it is now made available in pdf format. The pdf version provided is the final approved judgement.
